If Spike was to sign it away he'd make sure it didn't go to Angel first, lol. But right there we see that the shanshu is Angel's. He had to sign it away and if Spike does become human then it will be for that reason. As we have seen in Double or Nothing, destinies can be transferred to others but it is a stolen destiny and not one of their own works. If Spike becomes human it will be becaue of Angel's sacrifice and nothing more, IMO.
But why must it be one vampire. It says the vampire with a soul, yes, but I was reading the back of my season 5 boxset and that says, the "one" who will shanshu. Why is one in inverted commas? That suggests to me that it might not neccessrily be one. The Troclon talks about the vampire with a soul having a son. When was Connor was born there were two: Angel and Darla. Does that not mean that two vampires with souls had a child? I know hers was shared but it was there nonetheless. Why can't it be true of the shanshu?

Well destiny by it's very definition is supposed to be something that was going to happen to you. If it doesn't one could argue that it was never fated to happen to you. What the COTBT wanted to do was remove Angel's claim to the prophecy because at this point Spike and Angel as two vampires with souls have equal claim to the prophecy, but we still wonder if destiny can be stolen. Destiny and prophecy is vague at best so it's unclear whether what happens is fated to happen. Lorne has heard Angel sing many a time and he's sometimes says his destiny is fuzzy going as far as to say he hasn't seen a destiny with him featured in it. On that point I always thought Lorne read potential to a degree and that's what they took in THAW. If Spike becomes human? Well we don't know how the Shanshu will transpire or even if it's a reward. Maybe Angel signed something over to Spike that will be a great disadvantage to him.
Very ambiguous. Perhaps it's for emphasis or maybe it's quoting Angel and Spike. In reference to the Shanshu they have both referred to themselves as 'The One'.
We don't know, it could be. I said before to Glenn, just because it says one vampire will Shanshu doesn't mean that the other wont get a reward in become human (I don't even assume 'Shanshu' means become human) so it's all kind of up in the air.
